Terms of Service

These Terms of Service ("Terms") are an agreement between you and Clint Glenane, trading as Savannah Bytes (sole proprietor) ("Savannah Bytes", "we", "us") about the Spacepop mobile game (the "Game"). By buying, downloading or playing the Game you agree to these Terms. If you do not agree, do not use the Game.

Eligibility

The Game is intended for players aged 13 and over. If you are under the age of majority where you live, you may use the Game only with the consent of a parent or guardian, who accepts these Terms on your behalf.

Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game on devices linked to your Google account, for your own non-commercial entertainment. The Game is licensed, not sold. Your use of the Game is also subject to the Google Play Terms of Service.

Purchase and refunds

The Game is a one-time purchase through Google Play. There are no ads, subscriptions or in-app purchases. You can reinstall the Game at no extra cost on any Android device signed in to the same Google account.

Payments and refunds are handled by Google under the Google Play refund policy. Nothing in these Terms limits any rights you have under the South African Consumer Protection Act or other consumer protection laws that apply to you. If you have a problem with the Game, contact us at support@savannahbytes.com and we will try to help.

Updates

We may release updates that fix bugs, change or add content. Some updates may be needed to keep playing. Updates are covered by these Terms.

Acceptable use

You agree not to:

  • Copy, sell, rent, distribute or sublicense the Game
  • Modify, decompile or reverse-engineer the Game, except where the law expressly allows it
  • Remove any copyright, trademark or other notices
  • Use the Game for any unlawful purpose

Intellectual property

The Game and all of its content — including code, artwork, characters, audio and the Spacepop and Savannah Bytes names and logos — are owned by us or our licensors and are protected by copyright, trademark and other laws. Except for the licence above, no rights are granted to you.

Disclaimer

We work hard to make the Game fun and reliable, but to the extent permitted by law the Game is provided "as is", and we do not guarantee that it will be error-free, uninterrupted or compatible with every device. This does not affect any guarantees you are entitled to under consumer protection law.

Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for loss of game progress stored on your device, and our total liability to you for any claim relating to the Game is limited to the amount you paid for it. These limits do not apply where they are not allowed by law, including under the Consumer Protection Act, or to liability for gross negligence or wilful misconduct.

Termination

Your licence ends automatically if you break these Terms. You may stop using the Game and uninstall it at any time.

Governing law

These Terms are governed by the laws of the Republic of South Africa. If you are a consumer living elsewhere, you also keep the protection of any mandatory laws of your country of residence, and you may bring claims in your local courts where the law allows.

Changes to these Terms

We may update these Terms, for example when the Game changes. We will post the new version on this page with a new "last updated" date. Continuing to play after a change means you accept the updated Terms.
